Heard Shri S. Nagamuthu, learned senior counsel for the petitioner.
By this application the applicant V. Gopalakrishnan, who has been convicted and sentenced to undergo one year R.I. with a fine of Rs.1000/- for the offence under Section 120B read with Sections 420, 467, 468 & 471 read with 467 and 468 of I.P.C. and Section 13(1)(d) of Prevention of Corruption Act, 1988, seeks exemption ature Not Verified<br>Surrendering pursuant to the order of the High Court of Date: 2020-10,10<br>16:49:20<br>Macrosoft State Address dated 31.07.2023, passed in Criminal Appeal No.821 of 2013.
The learned senior counsel submits that the SLP is not likely to be heard in the immediate future and if the petitioner is not granted exemption from surrendering, the petition would be rendered infrucutous and, therefore, it would appropriate that till the matter is heard by an appropriate Bench, the petitioner may be
exempted from surrendering pursuant to the order impugned.
Considering the above submission, this Court deems it appropriate to allow the exemption application.
The petitioner shall not be forced to surrender pursuant to the order dated 31.07.2023 passed in Criminal Appeal No.821 of 2013 by the High Court of Judicature at Madras, till orders to the contrary are passed in the SLP.
The SLP shall be listed before an appropriate bench within next two months.
