Heard learned counsel for the parties and perused the record. Learned counsel appearing for the petitioner has stated that in terms of the earlier order of this Court, certain amount has already been paid and six post-dated cheques had also been given to respondent no. 2. He undertakes that all the post-dated cheques shall be honoured and none of them will get dishonoured under any circumstances. In view thereof, the matter is settled in terms of the earlier orders of this Court.
However, in case any of the post-dated cheques deposited with the respondent no. 2 by the petitioner is dishonoured, the respondent no. 2 shall have the liberty to revive this petition.
