The matter abovementioned was listed before the Ld. Registrar's Court on 30.10.2015 when the Court passed the following order:

"Await the return of the service of notice already issued to the unserved respondents. The served respondents have failed to file the counter affidavit within the period stipulated under the rules.

Ld.Counsel for the petitioner has stated that the respondent Nos.10, 11, 19, 21 & 25 have died. He seeks and is given four weeks time to take appropriate steps in this regard. Ld.counsel has also stated that he has filed the affidavit in proof of dasti service of the respondent Nos.24 & 40. Office shall verify the position and report accordingly. List the matter again on 19.01.2016."

It is submitted that Counsel for the petitioner has on 29.10.2015 filed affidavit of dasti service after effecting service of Notice to unserved respondent Nos. 24 & 40 but no one has entered appearance so far and dasti service upon respondent Nos. 10, 11, 19, 21 & 25 could not be served as the above said respondents have been expired but the counsel for the petitioner has not taken any fresh steps in this regard.

It is further submitted that Mr. C.S.N. Mohan Rao, Adv. has not filed the counter affidavit so far.

Service is incomplete.

The matter abovementioned is listed before the Ld. Registrar's Court with this office report.
