The matter above mentioned was listed before the Hon'ble Court on 05.01.2015 when the Court was pleased to pass the following order:
"Delay condoned.
Issue notice, returnable within eight weeks. There shall be stay of further proceedings in Corruption Case No. 8 of 2014, pending before the learned Special Judge, Kangra, Dharamshala, H.P., till the next date of hearing."
Accordingly Show Cause Notice returnable on 23.03.2015 was issued to all the six respondents through Regd. A.D. Post on 02.02.2015.
It is submitted that Ms. Pragati Neekhra, Advocate has filed Vakalatnama/Appearance on behalf of respondent Nos. 1 and 3 to 6.
It is further submitted that Ms. Pragati Neekhra, Advocate has also on 20.03.2015 filed counter affidavit on behalf of respondent no. 1. Copy of the Counter Affidavit is being circulated herewith for kind perusal of the Hon'ble Court.
It is further submitted that Ms. Pragati Neekhra, Advocate has also on 20.03.2015 filed counter affidavit with an application for exemption from official translation on behalf of respondent Nos. 3 to 5. The application has been registered as Criminal Miscellaneous Petition Nos.4756-4757 of 2015. Copy of the the Counter Affidavit and applications are being circulated for kind perusal of Hon'ble Court.
It is further submitted that neither AD card nor unserved cover containing notice has been received back in respect of respondent No. 2, so far.
It is further submitted that respondent No. 2 is the Chief Minister of the State of Himachal Pradesh.
Service of show cause notice is incomplete in respect of respondent no. 2.
The matter is listed before the Hon'ble Court with this office report.
