It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the common judgment and final Order dated 21st August, 2015 of Division Bench of the High Court of Madhya Pradesh at Jabalpur in ITA Nos. 34, 39, 41, 42 and 43 of 2012.

It is further submitted for information of the Hon'ble Court that SLP (C) Nos. 27702703 OF 2015 entitled "BALJINDER SINGH KHANNA vs COMMISSIONER OF INCOME TAX" arising out of similar issue which was listed before the Hon'ble Court on 24th September, 2016, when the Hon'ble Court has dismissed the same. (Copy of order dated 24th September, 2016 is enclosed herewith for reference).

It is also submitted that counsel for the petitioner has on 1st March, 2016 filed additional documents alongwith application for permission to file additional documents and the same have been registered as Interlocutary Application Nos. 1115 of 2016. Copies of the same have been included in the paper books.

It is also submitted that Mr. B. V. Balram Das, Advocate has filed Counter Affidavit on behalf of sole respondent. Copy of the same is being circulated herewith for the kind perusal of the Hon'ble Court.

It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the common judgment and final Order dated 21st August, 2015 of Division Bench of the High Court of Madhya Pradesh at Jabalpur in ITA Nos. 65 and 161 of 2012.

It is further submitted for the information of the Hon'ble Court that the instant matter

has been tagged with Special Leave Petition Nos. 3499735001 of 2015 entitled "M/S GLOBAL ESTATES vs COMMISSIONER OF INCOME TAXI , BHOPAL(M.P.)" as both are arising from similar issue.

It is also submitted that counsel for the petitioner has on 1st March, 2016 filed additional documents alongwith application for permission to file additional documents and the same have been registered as Interlocutary Application Nos. 34 of 2016 . Copies of the same have been included in the paper books.
