UPON hearing the counsel the Court made the following O R D E R Civil Appeal No. 362/2016, SLP(C) No. 6082/2016 and Civil Appeal No. 2790/2016 are taken on board. All the matters including the matters taken on board today pertain to the revision of pay scales of the respondents in these matters pursuant to the recommendation of the 6 th Pay Commission. The respondents succeeded before the High Courts and hence these SLPs/Civil Appeals by the Union of India. In some of the matters, pursuant to High Court's orders, the Union of India has been paying its employees/respondents in terms of the orders of the High Court. In some of the matters, the respondents are not yet paid inspite of the fact that they succeeded before the High Court.
Heard learned counsel for the parties. In the circumstances, we are of the opinion that uniformity of the judicial process in all these matters be maintained. We decline to grant any interim order. The Union of India will pay the amounts due to the respondents 3 in terms of the decisions of the High Court impugned in each of these matters. Any such payment would be further subject to the final outcome of these matters. We are informed that almost all the respondents/employees involved in these matters have considerably long period of service left. Therefore, it will not be difficult for the Union of India to take appropriate steps for the recovery of the amounts to be paid in case of the eventual success of the Union of India.
