UPON hearing the counsel the Court made the following<br>O R D E R

SLP (C) NO.5028/2022, SLP(C) NO.4952/2022, SLP(C) NO.5145/2022, SLP(C) NOS.524-525/2023

  1. Arising out of common impugned judgment dated 02.12.2021 passed by the High Court of Madhya Pradesh, Principal Seat at Jabalpur in First Appeal Nos. 289, 290 & 291 of 2008, modifying the order dated 26.02.2008 of Reference Court to enhance the compensation granted to respondents from Rs. 10,26,907/- to Rs. 1,33,45,508/ with solatium @ 30% and interest, the instant special leave petitions have been filed by the Narmada Hydroelectric Development Corporation Ltd. (NHDC).

  2. After hearing learned counsel for the parties at length and considering the documents brought, we are not inclined to interfere with the impugned judgment(s) of the High Court awarding compensation to holder of the land. Consequently, the special leave petitions filed by NHDC stand dismissed.

  3. Pending application(s), if any, also stand disposed of.

  1. Arising out of the same judgment and seeking enhancement, these special leave petitions have been filed by the claimants. After hearing and in the facts,

we do not find any ground to grant enhancement of compensation as awarded. Accordingly, the special leave petitions stand dismissed.

  1. As informed, since the claimants have received only 25% enhanced amount out of total deposit of 50% before the Reference Court. The remaining amount is lying in the fixed deposit with the Reference Court, the same be paid and transmitted in the accounts of the holders as per their entitlement. The remaining amount of compensation be also paid to claimants within a period of eight weeks from today.
