It is submitted that an application for exemption from surrendering (Criminal Misc. Petition No. 25368 of 2012) in the matter above mentioned was listed before the Hon'ble Judge in Chamber on 10th December, 2012 when His Lordship was pleased to pass the following order:

"Application for exemption from surrendering is declined.

The petitioner may surrender within four weeks from today.

In the event of default, the concerned police station is directed to take steps for apprehending the petitioner in accordance with law."

Counsel for the Petitioner has on 21st January, 2013 filed proof of surrender (Copy enclosed).

It is submitted that Mr. Rajiv Ranjan Dwivedi, Advocate has on 18th January, 2013 filed caveat with Vakalatnama/Appearance on behalf of Asalam who is neither a party nor compalainant before the Court.

The matter is, therefore, listed before the Hon'ble Court with this office report.
