"Respondent no.1 has not been served. The ld. Counsel for respondent no.2 has mentioned that Committee for respondent No.1 has been constituted since 2004 and all the Directors including Ms Pamila Syal as the representative Director for respondent no.1 were in custody or of her residence are available with the counsel for the respondent. However, as per the information by the counsel she has been released on bail but no particulars are available.

Petitioner in the given circumstances, shall take appropriate steps to effect service by way of paper publication.

Counter affidavit of respondent no.2 is already on record.

List again on 01.10.2015."

It is submitted that Mr. Rajinder Mathur, counsel for the petitioner has on 02.09.2015 filed an application for serving Respondent No.1 by paper publication but the same is defective for the reason that he has not mentioned the second newspaper which is in vernacular language to serve the Respondent No.1 by paper publication, but he has not cured the defect despite this

Registry's letter.

Service of show cause notice is incomplete in respect of Respondent No. 1.

The matter is listed before the Ld. Registrar's Court with this office report.
