Respondent no. 1 has failed to file counter affidavit despite last opportunity having been granted, as such, further opportunity stands declined.

Ld. Counsel for the petitioner submits that all the respondents are common in both matters and some of the respondents have been served in one matter and other respondents have been served in another matter and there is no need to serve them again in both matters. Let appropriate application in this behalf be filed within two weeks.
