UPON hearing the counsel the Court made the following O R D E R
SLP(C) No.20777-20779/2023
Respondent nos. 1, 2, 5 to 15, 17, 20 to 25, 27 to 36, 40, 41, 44 to 48, 50, 51, 54, 55, 58 to 64, 66 to 71 and 76 have filed counter affidavit.
Opportunity to respondent nos.16, 18, 19, 26, 37 to 39, 49, 52, 53, 56, 57, 65, 73 to 75, 78 to 80, 82, 84 to 98 and 101 to file counter affidavit has already been declined.
Counter affidavit filed in respect of respondent no.104 is still defective. Defects be cured within four weeks as last opportunity.
Ld. counsel for the petitioner is granted two weeks' time as final opportunity to take fresh steps and file fresh particulars in respect of unserved respondent no.106.
Ld. Counsel for the petitioner has not cured the defects in the application for substitution in respect of deceased respondent nos.42,43,72,81,99 and 100 despite last opportunity having been granted, as such, Registry to process the matter for listing before the Hon'ble Judge in Chambers for necessary directions.
Service is complete on remaining respondents but none has entered appearance.
