In continuation of the order dated 03.02.2022 which dealt with factual and legal contours of the instant controversy, a COMM Diance affidavit has been filed on behalf of the State of tarakhand. Paragraph 7 of the affidavit states as under:
"7. That as per direction of this Hon'ble Court, respondents have considered the matter and after due consideration of the claim of the Petitioners, it has
been found that out of the list of fourteen persons mentioned in the order dated 03.02.2022 seven have already been retired and only seven persons are still in service. Therefore, in the light of the direction issued by this Hon'ble Court, the benefit of promotion can be only granted to the remaining seven persons who are currently in service. The names are as follows:
Sl No. | Name | Date of appointment | District |
---|---|---|---|
1. | Vinod Sharma | 03.02.1989 | Dehradun |
2. | Shridhar Prasad | 043.10.1989 | Dehradun |
3. | Suresh Semwal | 10.10,1989 | Dehradun |
4. | Rajender Prasad | 12.12.1990 | Dehradun |
5. | Virender Sajwan | 06.08.1992 | Dehradun |
6. | Vinod Tiwari | 19.01.1998 | Dehradun |
7. | Abid Ali | 04.08.1998 | Dehradun |
It is quite clear that the benefit of promotion will now be extended to seven persons whose names are quoted in the tabular chart.
Considering the entirety of the matter, in our view, ends of justice have been met and nothing further need be done in the matter. We, therefore, direct the respondent to effectuate the proposal and issue necessary orders granting promotion to the afore-stated seven persons within five months from today.
The Special Leave Petition is disposed of accordingly.
Pending applications, if any, also stand disposed of.
