UPON hearing the counsel the Court made the following O R D E R

Civil Appeal No(s).5815/2023 and C.A. No. 5871/2023

• 1 Admit.
• 2 We have heard Mr K K Venugopal and Mr Mukul Rohatgi, senior counsel appearing on behalf of the appellant and Ms Pramila Nesargi, senior counsel with Mr Balaji Srinivasan, on caveat.
• 3 As an ad-interim measure, we issue the following directions:
  • (i) The directions contained in sub-paragraphs (i), (ii), (v) and (vi) of paragraph 174 of the impugned judgment and order of the High Court dated 1 September 2023 shall remain stayed;
  • (ii) The appellant shall not presently draw any allowances as a Member of Parliament. He shall be entitled to participation but shall not be entitled to cast his vote on the Floor of the House or in any of the Committees in which he is nominated as a Member; and
  • (iii) The appellant shall be entitled to contest in the next parliamentary elections, subject to any further directions that may be issued in these

proceedings.

• 4 The pleadings shall be completed within a period of four weeks.
• 5 Liberty to mention for a specific date of listing thereafter.
