UPON hearing the counsel the Court made the following O R D E R
This petition arises out of an order in which the issue of dealing with stray dogs in a residential complex.
The High Court, in the order appeal against, has referred to a pending Special Leave Petition, Animal Welfare Board Of India Vs. People For Elimination Of Stray Troubles(Civil Appeal No.5988/2019 arising out of SLP(C)No.691/2009) and has observed:-
"8. In the circumstances aforesaid and after considering the aforesaid submissions, in our considered opinion, judicial discipline and proprietary demands that we direct the parties hereto to forthwith approach the Supreme Court and seek a clarification as to whether the issue raised in the present Writ Petition be decided by the Supreme Court or this Court considering that the order passed by the Supreme Court was passed over 6 years ago.
9. We note that there is immense urgency in the matter considering that the present Writ Petition concerns the welfare and protection of over 38 dogs in a residential complex spread over 50 acres of land. We also note that the fines / penalties imposed on the Petitioners for

feeding stray dogs has accumulated to over lakhs of Rupees, and the Society wants to take coercive action against the Petitioners."
In our opinion, this Special Leave Petition has to be heard with Civil Appeal No.5988/2019 arising out of SLP(C)No.691/2009. Tag this matter with Civil Appeal No.5988/2019.
