UPON hearing the counsel the Court made the following

CIVIL APPEAL NO. 5618/2015

Service is complete but the respondents have not filed counter affidavit despite expiry of statutory period and though respondent no. 1 has filed but after the expiry of statutory period. As such, Registry to make a specific mention in the office report at the time of listing.

The appellant has already filed an application for directions but learned counsel appearing for the appellant submits that he wants to withdraw the application.

As such, Registry to process the matter for listing before Hon'ble Court.

Respondent no. 1 has already filed counter affidavit

Despite last opportunity having been granted, respondent nos. 2-4 have not filed counter affidavit, as such, further opportunity is declined.

Four weeks time, as last opportunity is granted to respondent no. 6 for filing counter affidavit.

Two weeks time, as last opportunity is granted for taking fresh steps for service of respondent nos. 3, 5, 7-9 in CA No. 7193-7194/2015. Notice be issued thereafter.
