UPON hearing the counsel the Court made the following $0 R D E R$
Heard learned Senior Counsel for the parties.
2. As the victim is a necessary party for proper adjudication of the dispute in question, she may be impleaded as party respondent No.3.
3. Issue notice.
4. Mr. Sandeep Singh, learned counsel, who appears on caveat on behalf of respondent No.2/complainant, accepts and waives service of formal notice upon the said respondent.
5. Liberty is granted to the petitioner to serve respondent No.1 through its Standing Counsel.
6. Counter affidavit, if any, be filed within six weeks.
7. Post the matter for hearing on 04.08.2023.
8. Meanwhile, exemption from surrendering granted to the petitioner vide Order dated 17.02.2023 shall continue to operate.
9. The amount of cost of Rs.5,00,000/-, deposited by the petitioner pursuant to Order dated 17.02.2023, is ordered to be released to respondent No.3/victim without prejudice to her legal rights.
