Opportunity to respondent nos. 7 to 9 to file counter affidavit has already been declined.

Ld. Counsel for the petitioner to take fresh steps to effect service on respondent nos. 1 to 3 within two weeks time. Notices thereafter be issued.

None appears for respondent no.6 despite due service.

Ld. Counsel for the petitioner to take fresh steps to effect service on respondent nos. 13 & 6 within two weeks time as last opportunity. Notices thereafter be issued.

Respondent no.5 is granted four weeks time as last opportunity for filing counter affidavit.

Respondent nos. 4 and 7 are granted four weeks time for filing counter affidavit.

List again on 1.2.2017.

It is submitted that there are nine respondents in this matter. Counsel for the petitioner has on 18.1.2017 filed spare copies which is barred by time by 20 days. Hence show cause notice has not been issued in respect of respondent Nos. 13. Mr. E.C Agarwala, Advocate for respondent Nos. 45 and Mr. Abhay Kumar Advocate for respondent Nos. 79 has not filed Counter Affidavit. As per tracking report, respondent No. 6 has been served . SLP (C) No. 11082/2016

It is submitted that counsel for the petitioner has not taken any steps for effecting service on unserved respondent Nos. 13 and 6. Hence show cause notice could not be issued. Mr. E.C Agarwala, Advocate for respondent No. 4, 5 and 7 has not filed Counter Affidavit on their behalf so far.

Service of show cause notice is not complete on respondent Nos. 13 and 6.
