The matter above mentioned was listed before the Hon'ble Court on 10.02.2017, when the Court was pleased to pass the following Order:-
"Issue notice.
Mr.R.K.Bhardwaj, learned counsel has entered appearance on behalf of respondent No.2, no further notice shall be issued to him.
As far as remaining respondents are concerned, notice be issued to them returnable within twelve weeks.
Status quo, existing as on today, shall be maintained by the parties until further orders. Application for deletion of name of respondents stand rejected."
It is submitted that as directed above, show cause notice to Respondent Nos. 1 and 3 to 28 was issued on 28.02.2017 by registered AD. Mr. Rajiv Sharma Respondent No. 2 in person has already filed Caveat/Memo of Appearance. Mr. Satyendra Kumar, Ms. Sumita Hazarika and Mr. Arun Kr. Sinha, Advocate have filed Vakalatnama/Appearance on behalf of Respondent Nos. 1, 5 and 7. Counsel appearing for Respondent No. 7 has on 03.05.2017 filed counter affidavit and the same is being circulated herewith. AD cards duly signed in respect of Respondent Nos. 3, 4, 6, 8, 10 to 13, 15, 17, 23, 25 and 27 but no one has entered appearance on their behalf so far. Unserved covers in respect of Respondent Nos. 14, 22, 24, 26 and 28 with postal remark's "Expired in respect of Respondent No. 14 and No such person, incomplete address and not reside at given address in respect of Respondent Nos. 22, 24, 26 & 28. Respondent Nos. 16, 18, 20,
21 had expired as per Cause Title of the SLP and application for deletion the name of Respondent Nos. 16, 18 and 21 was rejected vie Order dated 10.02.2017. Counsel for the petitioner has not taken any steps in respect of deceased respondent no. 20 so far.
It is further submitted that Mr. Harish Bhardwaj, General Power of Attorney of M/s. Hansraj Sharma and Ravi Dutt Respondent Nos. 9 and 19 has on 01.05.2017 filed two separate applications for appearing and argue in person alongwith counter affidavits without serving the copies on Ms. Sumita Hazarika, Mr. Arun Kr. Sinha, Advocates and Mr. Rajiv Sharma, Respondent in person No. 2. He has mentioned Respondent Nos. 4(b) and 7(d) instead of Respondent Nos. 9 and 19 in the applications as well as in the counter affidavits. He has also filed wrong affidavit alongwith application and counter affidavit of Respondent No. 19. He was requested vide this Registry's letter dated 03.05.2017 to cure the above said defects but he has not done the needful so far. However, applications and counter affidavits are being circulated herewith.
