Despite notice served, the impleaded respondent has not appeared before this Court.
Learned counsel for the appellant submits that the vacant possession of the premises has been handed over. The allegation involved a civil dispute.
Considering the said submission made, especially the fact that vacant possession has been handed over, coupled with the fact that the co-accused, namely, the wife of the appellant has been granted anticipatory bail, we are inclined to set aside the impugned order.
Accordingly, the impugned order is set aside and the appellant is granted bail on terms and conditions to the satisfaction of the trial Court.
The appeal stands allowed accordingly.
