UPON hearing the counsel the Court made the following O R D E R

Heard learned counsel appearing for the parties, particularly the learned counsel appearing for the Election Commission of India.

Taking into consideration the seriousness of the issue involved in this petition, we have passed an elaborate order on the last date of hearing i.e. on 5.09.2017 and requested the Election Commission of India to place before this Court all the guidelines regarding the procedure to be followed by the flying squads, or similar authorities with respect to search, seizure and prosecution of other criminal matters involving elections.

Today, the learned counsel who appears on behalf of the Election Commission of India produced the current guidelines.

Learned counsel appearing for the State submits that apart from that there are some other important issues regarding the protection of Electronic Voting Machines ("EVMs") after the elections are over.

Taking into consideration all these aspects and after hearing the learned counsel for the parties we deem it appropriate to issue notice to the Union of India also to assist us in resolving the issue.

Issue notice to the Union of India.

We direct the learned counsel for the Election Commission of India to place on record the current guidelines by way of a proper affidavit.

List after one week.
