UPON hearing the counsel the Court made the following O R D E R
Heard learned senior counsel for the petitioner University, learned counsel for the respondents and we have perused the order impugned in the petition.
Delay condoned.
Though contentions on merits have been urged, we notice that the respondents herein who were the beneficiaries of the order passed by the High Court, have all retired from the service and such if the benefit as ordered is given to them in monetary terms, it would not affect the service conditions of the persons who are in service and are promoted. In that view without expressing any opinion on the merits of the contentions urged, the Special Leave Petitions are dismissed in the facts and circumstances involved in this case.
However, the questions raised in these petitions are kept open to be urged in an appropriate proceedings, if the same arise for consideration therein.
Pending application(s) shall stand disposed of.
