Heard Mr. Manish Kumar, learned counsel appearing for the petitioner (Wife). Also heard Mr. Rana Sandeep, learned counsel appearing for the respondent (husband).
2. The counsel for the respondent makes various contention to oppose the transfer plea by citing that the petitioner is a self-employed person and she has sibling who can also assist in looking after her ailing mother.
3. The petitioner's counsel however points out that a criminal case is filed before the P.S. Women Ramamurthy, Rajamahendravram against the respondent. Besides, a petition for Restitution of Conjugal rights has also been filed by the petitioner against the respondent and proceedings are pending before the Rajamahendravram Court.
4. Having regard to the circumstances in this case, we deem it appropriate to order transfer of the Family Court Original Petition No.489/2022 titled as "Challa Sundeep Babu vs. Kalepu Raja Rajeswari", pending before the court of Family Court, Secunderabad, Hyderabad, Telangana to court of competent Digitally signed by Jayant Kumar Arora Date: 2024.02.01 17:32:44 IST Reason: Signature Not Verified
jurisdiction in the East Godavari district, Andhra Pradesh. It is ordered accordingly.
5. The Family Court, Secunderabad, Hyderabad, Telangana shall send the case records to the transferee Court without any delay.
6. After transfer of the case papers, the transferee Court is directed to make endeavour either for amicable settlement or for early decision in the matter without unnecessary adjournments.
7. If the respondent seeks participation through video conferencing, the same should be considered as per the orders of the transfree court.
8. The Transfer Petition is allowed in the aforesaid terms. Pending application(s), if any, shall stand closed.
