UPON hearing the counsel the Court made the following O R D E R
In terms of the office report dated 1st March, 2016, the paper books have been received in the Transferred Cases from the Karnataka High Court, Allahabad High Court, Orissa High Court, Bombay High Court, Delhi High Court, Rajasthan High Court, Madhya Pradesh High Court, Kerala High Court, Patna High Court and Punjab and Haryana High Court.
We propose to take one case from each of these High Courts as the lead case for the purpose of disposal of this batch of cases. This is being done because learned 12
counsel for the parties say that the notification in each State may not be the same, but in fact would be different. The Registry should, therefore, list all the matters State-wise.
On the request made on behalf of learned amicus curiae, we adjourn the matters for six weeks. In the meanwhile, learned amicus curiae may decide which cases should be taken up as the main case and if there is any further information that any of the learned counsel wish to provide to learned amicus curaie to assist us in the disposal of this batch of cases, that information should be supplied to him within four weeks.
We request learned amicus curiae to complete the exercise of inspection and identification within six weeks from today.
List the matters after six weeks.
The parties are at liberty to file their written submissions within four weeks before learned amicus curiae, who will then make a compilation of the submissions so that there is no duplication of the submissions.
Mr. P.H. Parekh, learned senior counsel appearing in Transferred Case arising out of Transfer Petition (C) No.1148 of 2012 says that Writ Petition No.1631 of 2012 has not been disposed of by the Bombay High Court. His 13
statement is taken on record.
I.A. No.35 of 2011 in SLP(C) No.16308 of 2007 for impleadment is dismissed as not pressed.
