UPON hearing the counsel the Court made the following O R D E R

After hearing learned counsel for the parties and without prejudice to their rights to prosecute and defend this litigation, we direct the respondent-State to pay 50% of the amount demanded by the petitioner in this litigation. The amount shall be calculated and be paid to the respective petitioner on verification.

We again make it clear that the question whether the petitioner is entitled for the payment of gratuity under the Act in question or as per scheme of the respondent-State in their counter is kept open for being decided at a later stage.

Let the amount be paid to the petitioner individually within a period of one month from today.
