The matter above mentioned was listed before the Ld. Registrar on 11.02.2015, when he was pleased to pass the following order:

"The learned counsel for the appellant shall file the fresh particulars of the respondent No.4 within a period of three weeks and he shall also take appropriate steps for the service of notice to him within the same period. Dasti in addition is permitted to be served through the Trial Court the particulars of which shall be furnished by the learned counsel for the appellant within the period prescribed above.

Service of notice is complete on the respondent Nos. 1 to 3 but no one has entered appearance on their behalf.

List again on 21.4.2015."

It is submitted that counsel for appellants has neither furnished fresh address of Respondent No. 4 nor has filed copy of pleadings alongwith address of Trial Court with result fresh notice could not be issued to Respondent No. 4.

Service of notice of lodgment of petition of appeal is not complete on Respondent No. 4

As per directions Original Record has been returned to the concerned High Court.

It is further submitted that Counsel for the both parties have not filed statement of case.
