The matters above-mentioned were listed before the Hon'ble court on 11.11.2016, when the court was pleased to pass the following order:

"It is seen that the litigation is pending since 1981. For giving a quiteus to the issue, issue notice. In the meantime, there shall be stay of operation of the impugned judgment and order dated 04.03.2016 of the High Court of Calcutta and stay of all proceedings in Reference No. 16 of 1999 pending before the Central Government Industrial Tribunal, Calcutta."

It is submitted that accordingly, show cause notice was issued on 25.11.2016 to all the Respondents through Regd. AD Post. Mr. V. Siva Subramanian, Advocate has on 22.12.2016 filed vakalatnama on behalf of respondent No. 1 in SLP (C) No. 32752 and 32766 of 2016, but Counter Affidavit has not been filed so far. Neither AD Card nor unserved cover has been received back so far in respect of all the respondents.Track report shows that "item delivered" at NEW DELHI, GPO of respondent Nos. 2 & 3 common in all the SLPs and "Item Delivered" at LR, SARANI of respondent Nos. 4 and 5 common in all the SLPs.

It is further submitted that Mr. V. Siva Subramanian, Advocate has on 22.12.2016 filed an application for substitution to bring on record the Lrs. Of deceased respondent No. 1 (Viz.Mihir Chandra Bandhopadhyay) alongwith vakalatnama and memo of appearance on behalf of Smt. Geeta Bandhopadhyay widow of deceased respondent No. 1 in SLP (C) No. 32113/2016, but the same is defective for the reasons that he has not mentioned age of Lrs. And also not filed notice of motion and application for setting aside abatement so far.

Service seems to be completed in respect of respondent Nos. 2 & 3 common in all the SLPs. As per track report. (enclosed herewith)

The matters above-mentioned are listed before the Ld. Registrar Court with this office report.
