The matters above mentioned were listed for hearing before this Court on the 21.10.2016 when the Court was pleased to pass the following Order:

"Delay condoned.

Issue notice returnable within four weeks.

Dasti, in addition, is permitted.

Mr. Yatin Oza, learned senior counsel being assisted by Mr.Purvish Jitendra Malkan, learned counsel for the petitioner prays for rectification of the cause title to add the name of a respondent as it has been mistakenly not impleaded. Prayer stands allowed. The cause title be rectified accordingly.

There shall be stay of further investigation as the investigation is continuing in pursuance of the order passed by the High Court. That apart, the proceedings before the High Court in Special Criminal Application (Quashing) No.4357 of 2016 shall remain stayed.

List the matter on 22.11.2016."

Accordingly, Show Cause Notice was issued to all the common three respondents in both the matters through Regd. A.D. Post on 03.11.2016.

It is submitted that as per track records of Regd. post (copies enclosed), notices have been delivered to Respondent Nos. 1 and 2 but no one has filed Vakalatnama/ Appearance so far. Mr. Vikash Singh, Advocate has filed vakalatnama/Appearance on behalf of Respondent No.3 in Special Leave Petition no. 8105 of 2016.

It is further submitted that counsel for the petitioner has on 07.11.2016 filed affidavit of dasti service in respect of Respondent No. 1 & 2 stated that they have been served personally.

Service of notice is complete on all the Respondents.

SPECIAL LEAVE PETITION (CRL.) NOS. 81498152 OF 2016

The matters above mentioned were listed for hearing before this Court on the 28.10.2016 when the Court was pleased to pass the following Order:

"Issue notice, returnable within two weeks.

Liberty is granted to the learned counsel for the petitioner to serve a copy on the counsel who is representing the respondent in S.L.P.(Crl.) No. 8105 of 2016.

Let the matter be listed along with S.L.P.(Crl.) No. 8105 of 2016 on 22nd November, 2016."

Accordingly, Show Cause Notice was issued to all the six respondents through speed post on 08.11.2016.

It is submitted that as per track records of speed post (copies enclosed), notices have been delivered to all the six respondents but no one has filed Vakalatnama/ Appearance so far.

It is submitted that Mr. P.J. Malkan, Advocate has on 21.11.2016 filed counter affidavit on behalf of Respondent No. 1 in Special Leave Petition No. 8151 of 2016 after obtaining prior permission of the Hon'ble Court as per the endorsement made by the concerned Court Master on the filing memo but the counsel has not filed Vakalatnama/Appearance. Copy of the same is being circulated herewith for kind perusal of the Hon'ble Court.

Service of notice is complete.

The matters above mentioned are, therefore, listed before the Hon'ble Court with this office report.
