PETITION FOR SPECIAL LEAVE TO APPEAL (CRL.) NOS. 1008710089 AND 10086 OF 2015

The matters abovementioned were listed before the Hon'ble Court on 13th January, 2017, when the Court was pleased to pass the following order:

"Perused the letter circulated by the learned counsel for the respondents seeking adjournment for filing Counter Affidavit.

Counter Affidavit be filed within four weeks.

Rejoinder Affidavit, if any, be filed within two weeks thereafter.

The petitioner shall take steps for completion of service on the unserved respondent(s) within four weeks. Dasti, in addition, is permitted.

It is made clear that if no steps are taken within the stipulated time, the unserved respondent(s) shall be deleted from the array of parties at the risk of the petitioner.

List after six weeks. "

Special Leave Petition (Crl.) Nos.1008710089 of 2015

It is submitted that pursuant to aforesaid Order counsel for respondent nos. 1 & 3, have not filed counter affidavit, so far. Hence no rejoinder affidavit.

It is further submitted that counsel for the petitioner has not taken steps to serve the unserved respondents. As directed above, cause title has been amended and name of the unserved respondent has been deleted from the array of parties. Amended cause title is already included in the SLP paper books.

Service of show cause notice on remaining respondents is complete.

Special Leave Petition (Crl.) No.10086 of 2015

It is submitted that there is sole respondent in the matter and counsel for the petitioner has not taken steps to serve the unserved sole respondent. As directed above, the name of sole respondent is deleted. No respondent is remain in the SLP. Amended cause title is already included in the SLP paper books.

The matters abovementioned are, therefore, listed before the Hon'ble Court with this office report.
