This appeal arises on the impugned final order passed by the High Court of Judicature at Allahabad in Criminal Misc. Bail Application No.55500/2021 dated 11.08.2022. FIR No.475/2020 has been registered against the appellant for offences punishable under Sections 420, 406, 409 and 120-B of the Indian Penal Code. Admittedly, he has been arrested on 13.07.2021 and since then he has been in custody. As per the impugned order his application for regular bail was rejected. It is the said circumstances that the appellant has filed this appeal. When this matter is taken up for consideration, the learned Standing Counsel appearing for the State of Uttar Pradesh submitted that charge sheet has already been filed in this case.

Taking into account the factum of filing of charge sheet and also the fact that the appellant has been in custody since 13.07.2021, We are of the considered view that the appellant can be enlarged on bail. We, accordingly, set aside the impugned final sionOr.der passed by the High Court of Judicature at Allahabad in

In the said circumstances, the appellant is ordered to be enlarged on bail subject to the conditions to be imposed by the Court concerned.
