The matter above mentioned was listed before the Learned Registrar's on 17/04/2015 when he was pleased to pass the following Order:

"The respondent No. 1 has failed to file the counter affidavit within the period stipulated under the rules. Ld. counsel for the respondent No. 1 seeks and is given four weeks time to file the vakalatnama and the counter affidavit on behalf of the respondent Nos. 25.

Fresh steps for the service of notice by usual mode to the unserved respondent No. 6 shall be taken by the Ld. Counsel for the Petitioners within a period of three weeks. Dasti in addition is permitted to be served through the Ld. Standing counsel representing the State of West Bengal. Service of notice is complete on the respondent No. 7, but no one has entered appearance on his behalf. List again on 06.08.2015."

It is submitted that Mr. Shibashish Misra, Advocate has on 23/07/2015 filed Counter Affidavit and Vakalatnama & Memo of appearance on behalf of Respondent Nos. 1 to 5. But the same is defective for the reason that Respondent No. 3 has executed the Vakalatnama & Memo of appearance on behalf of himself and for Respondent No. 5, but he has not filed General Power of Attorney, despite Registry's letter dated 27/07/2015.

It is further submitted that Mr. Anip Sachthey, Advocate has put in appearance on behalf of Respondent Nos. 6 & 7, but has not filed Counter Affidavit so far.

The Service of notice is complete on all the respondents.

The matter is listed before the Ld. Registrar Court with this OfficeReport.
