The matter above mentioned was listed before the Hon'ble Court on 03.02.2017 with office report dated 02.02.2017, when the Court was pleased to pass the following Orders:

"Let fresh notice be issued to the unserved respondents, returnable in six weeks."

Accordingly, fresh show cause notice returnable for 24.03.2017 was issued to respondent nos. 1, 2, 4, 5 and 8 on 14.02.2017 through Registered A.D. Post. Neither A.D. Cards nor unserved covers, containing show cause notice, have been received back so far. As per Tracking Report of India Post, notice in respect of respondent nos. 1, 2, 4 and 8 has not yet been delivered and notice in respect of respondent no. 5 has been received back with postal remarks "Deceased" . (Tracking Report is enclosed herewith).

It is submitted that respondent nos. 3, 6 and 7 have already been served with the notice, but no one has entered appearance on their behalf so far.

It is further submitted that Mr. Rajesh Mahale, counsel for the petitioners has on 21.03.2017 filed an application for dispensing with the service of notice on respondent nos. 4, 5 & 8. The same is registered as I.A. No. 2. Copy of the same is being circulated for perusal of the Hon'ble Court.

Service of show casue notice on respondent Nos. 1, 2, 4, 5 and 8 is not complete.

The matter above mentioned is listed before the Hon'ble Court with this Office Report.
