For Respondent(s) UPON hearing the counsel the Court made the following O R D E R Delay condoned. The impugned order is passed by the High Court in the petition which is filed by the petitioner under Section 482 of the Code of Criminal Procedure in which the petitioner had prayed that the respondents be directed to register FIR on the complaint which was given by the petitioner on 29.01.2004 and investigate upon the said compliant and prosecute the 1 SLP CRLMP No. 7590/2016 same. The High Court has noticed that the police has investigated into the matter and recommended the closure of the case on the ground that the dispute was civil in nature. On that basis, the High Court has disposed of the petition. We do not want to interfere with the impugned order. However, it would always be open to the petitioner to file protest petition to the inquiry report which is filed by the police before the Magistrate and impress upon the Magistrate to register the same. As and when the protest petition is filed, the same shall be considered by the trial court in accordance with law. The special leave petition is disposed of with the aforesaid observation.
