The matter alongwith I.A. no. 3 above-mentioned was listed before the Hon'ble Court on 31.03.2017 with office report dated 23.03.2017, when the Court was pleased to pass the following Order:-

"Perused the letter circulated by learned counsel for the respondent seeking adjournment for filing counter affidavit.

It is submitted by the learned counsel appearing for the petitioner that even after five months counter affidavit has not been filed.

However, in view of the persuasive request made by the learned counsel for the respondent, the respondent is granted one month's time, by way of last chance, to file the counter affidavit. We make it clear that in case the counter affidavit is not filed within the time granted, it will be taken that the respondent has no objection if the special leave petition is allowed.

In view of the prayer made by the learned counsel for the respondent, seeking time to file counter affidavit, we request the Superior Court of New Jersey, Chancery Division, Family Part, County of Camden to defer all further proceedings.

The Registry is directed to communicate this order to the Court concerned.

The submission made by the learned counsel on both the sides that they will make a joint request to deffer the proceedings is also recorded.

Post on 04.05.2017."

It is submitted that the above order was communicated to the Superior Court of New Jersey, USA vide this Registry letter dated 05.04.2017.

It is further submitted that as directed above counsel appearing for the sole respondent has on 29.04.2017 filed counter affidavit with annexures R-1 to R-3 alongwith an application for permission to file additional documents as annexure R-1 to R-3. The application has been registered as I.A. No. 4. Both Counter Affidavit and application are being circulated herewith.

The matter alongwith applications above-mentioned is listed before the Hon'ble Court with this Office Report.
