It is submitted that SLP No. 5142/2016 @ SLP CC...2265/2016 arising out of similar issue was disposed of by the Hon'ble Court on 12.02.2016 (copy of the Order dated 12.02.2016 is Annexed as Annexure P11 at page nos. 204206).

It is further submitted that Civil Appeal Nos. 72617262/2015 referred to as Annexure P9 was dismissed by the Hon'ble Court on 17.9.2015 (Copy of the Order dated 17.9.2015 is annexed as Annexure P10 at page nos. 131203).

It is also submitted that SLP D. No. 17592/2016, arising out of similar issue was dismissed by the Hon'ble Court on 01.08.2016 (Copy of the Order dated 01.08.2016 is enclosed herewith).
