Learned counsel for the petitioner, on instructions, submits that the petitioner offers payment of the consideration amount with interest thereon against the alternative claim of the respondents for refund of earnest money with interest

if specific performance is not granted. Learned senior counsel for the respondents submits that since this offer has been made for the first time, he seeks time to take instruction in this regard.
