The matter above mentioned was listed before Hon'ble Court on 13.12.2013, when the Court was pleased to pass the following order:-

"Delay condoned. Issue notice.

We notice that this matter can be disposed of without referring it to the Larger Bench, as and when respondent enters appearance."

It is submitted that pursuant to aforesaid order show cause notice to sole respondent was issued on 08.02.2014 by registered A.D. A.D. Card duly signed has been received from the Respondent but no one has entered appearance so far.

For non filing of appearance by the sole respondent, the matter was listed before the Court of Ld. Registrar on 18.07.2014, when the following order was passed:-

"What gets revealed from the perusal of the office report is that service is complete as against the sole respondent, but no one has entered appearance on his behalf. Viewed in that context, the matter shall be processed for listing before the Hon'ble Court under the rules."

The matter above-mentioned is listed before the Hon'ble Court with this Office Report.
