UPON hearing the counsel the Court made the following O R D E R Delay condoned.

Having heard learned counsel for the petitioner, in the facts and circumstances we see no reason to interfere with the impugned order.

However, taking note of the nature of allegations and contention put forth by the petitioner, on payment of the compensation to the claimants in the Motor Accidents Claims case, it would be open for the Insurance Company to proceed against the owner for recovery of the amount.

With the said observations, the special leave petition stands disposed of.
