SECTION IV-B
COURT NO.15
1. Again, this is one of the matters, where only one Diary Number is given for the SLPs arising out of the common order passed by the High Court in five R.F.As., and only one cause title has been filed by the petitioner.
2. Inconsistency is also noticed in the connected matter, i.e., Diary No(s).37917/2023, which is filed by the Haryana State Industrial Infrastructure Development Corporation Ltd. & Etc., Etc., where one Diary Number is given for number of SLPs, and separate cause titles have been filed by the petitioners.
3. The anomaly arises, more particularly, in land acquisition matters, when the number of appeals are disposed of by the High Court by a common order, which is challenged before this Court and in between, either during the pendency of the appeals before the High Court and/or before the SLPs are filed before this Court, some of the parties, i.e., the claimants - landowners die and the applications for condonation of delay; setting aside of abatement; substitution of legal heirs are filed.
4. It becomes just impossible to correlate as to which of the applications are filed in which of the SLPs, as all SLPs are registered under one Diary Number, without submitting separate cause titles of the SLPs, and without clarifying as to which applications are filed in which of the SLPs.
5. Such anomalies have also been pointed out by this Court in other matters (Special Leave Petition (Civil) Diary No.29606/2023, dated 18.03.2024) by passing judicial orders.
6. Registrar (Judicial) is again directed to personally look into the matter for a better system to be evolved for registration of the separate SLPs, and report.
7. List after four weeks.
