UPON hearing the counsel the Court made the following O R D E R

Last time, we have issued notice only on application for bail without giving a notice on the Special Leave Petition.

Hence, issue notice on the Special Leave Petition.

Mr. P.K. Dey, learned counsel appearing for the State of N.C.T. of Delhi accepts and waives formal notice.

Mr. P.K. Dey prays three weeks' time to file counter affidavit which is granted. Any rejoinder affidavit/additional documents may be filed by learned counsel appearing for the petitioner within two weeks thereafter. In the meantime, the petitioner be released on bail with the following conditions:-

  • (a) The Petitioner shall furnish a bond of Rs.25,000/-(Rupees Twenty Five Thousand only) with one surety to the satisfaction of the concerned Court;
  • (b) The petitioner shall appear before the I.O. thrice a week and further as and when the Inquiry Officer calls him for investigation, he shall appear before him without fail. The petitioner shall cooperate with the investigating agency in all manners;
  • (c) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. He shall not take any steps to tamper with the evidence; and
  • (d) The concerned court may impose any other conditions if it finds necessary.
