The matter above mentioned was listed before the Hon'ble Court on 3rd May 2013, when the Court was pleased to pass the following order:

"Learned counsel for the petitioner states that the issue raised in this Special Leave Petition is identical with the issue raised in S.L.P.(C)No.4042/2010.

Notice on the application for condonation of delay as also on the Special Leave Petition. Tag with S.L.P.(C)No.4042/2010."

Accordingly, show cause notice was issued to all the seven respondents. Mr. Anil Srivastava,and M/s. Corporate Law Group, Advocates have filed vakalatnama/ appearance on behalf of respondent nos.1.and 4 to 6. respectivelly. Neither A.D. card nor unserved containing the notice has been received back from the respondent nos. 2, 3 and 7 so far.

Thereafter,Office Report with regard to service position of notice was listed before the Registrar's Court from time to time and lastly the matter was listed on 29th September,2015 when the following order was passed:

"The office report indicates that although by order dated 22.07.2015 of this Court, three weeks time as last chance was given to the Ld. Counsel for the petitioners to file the affidavit in proof of dasti service of notice issued to the respondent Nos.2,3 & 7,yet he has not done the needful within the period stipulated in the order. Viewed in that context,the matter shall be processed for listing before the Hon'ble Judge in Chambers for further future directions. Await orders and list thereafter."

It is submitted that counsel for the petitioner has not filed affidavit of dasti service alongwith proof of service in respect of unserved respondent Nos. 2,3 and 7 so far.

The office report on default is listed before the Hon'ble Judge in Chamber for orders. Dated this the 3rd day of October, 2015.
