UPON hearing counsel the Court made the following O R D E R

Respondent No.1 has failed to file counter affidavit within the time granted by the Court (two chances over).

Counter affidavit on behalf of respondent No.2 has been filed on record by the learned Advocate, Mr.Paban K.Sharma, appearing on behalf of Mr. Himanshu Shekhar, Advocate-on-Record. It has been submitted at Bar by the learned counsel that the counter affidavit filed by respondent No.2 be treated for respondent No.5 also. He has undertaken to file the vakalatnama on behalf of respondent No.2 within a week. Item No.45 -2-

Copy of the counter affidavit be served on the other side. Respondent Nos.3 and 4 are reported to be duly and properly served but none appeared nor any steps have been taken on their behalf. On compliance, Registry to process the matter for listing before the Hon'ble Court, as per rules.
