The office report indicates that the learned counsel for the petitioner has filed an application for substitution to bring on record the Lrs. of the deceased respondent No. 9(i) which is defective. The learned counsel shall within a period of four weeks rectify the defects whatever have been found in the said application.

Fresh steps for the service of notice by usual mode to the respondent No. 5 shall be taken by the learned counsel for the petitioner within a period of four weeks. List again on 20.2.2017."

It is submitted that counsel for the petitioner has also filed application for substitution to bring on record the Lrs. of deceased Respondent No. 9(i) and application for condonation of delay in filing substitution application alongwith setting aside abatement. In the application, he has mentioned that Respondent No. 9(i) ri.e Sh. Singara Ram son of Mehar Chand died in the year 2014 leaving behind 2 Lrs. as per information received. But he has not annexed any proof regarding death of deceased Respondent No. 9(i). In this regard, he has filed a letter dated 27.01.2016 stating therein that Respondent No. 9(i) died in the year 2014 out exact date of death of the respondent could not be found despite making effort and further request to process for application (Copy of letter dated 27.01.2017 is enclosed herewith).

It is submitted that no postal report has been received from Postal Department in respect of Respondent No. 5 so far.
