OFFICE REPORT ON DEFAULT

The matter above mentioned was listed before the Hon'ble Court on 23.01.2012, when the Court was pleased to pass the following order :

" Issue notice on the applications seeking condonation of delay as well as on the special leave petitions. Tag with SLP (C) No.24224 of 2010. Statusquo prevailing as on date shall be maintained."

Accordingly, show cause notice by Regd. A.D. Post was issued on 04.03.2012. Mr. Kamal Mohan Gupta, Advocate has filed Vakalatnama\Memo of Appearance and Counter Affidavit on behalf of Respondent Nos. 14. Neither AD Cards nor unserved covers containing notice have been received back from Respondent No. 5 so far. Service not being complete and the matter above mentioned time to time listed before the Ld. Registrar Court on 27.01.2016, when inter alia the following order was passed:

" Ld.counsel for the petitioner has failed to take fresh steps in respect of the respondent No.5 in spite of last chance granted. Viewed in that context, the matter shall be processed for listing before the Hon'ble Judge in Chambers for further directions. Await orders and list thereafter."

The office report on default in the matter above mentioned was listed before the Hon'ble Court (In Chamber) on 29.07.2016, when the Court was pleased to pass the following order :

" Two weeks' time is granted to the learned counsel for the petitioner to comply with the Office Report dated 14th May, 2016, failing which, the Special Leave Petitions shall stand dismissed without further reference to the Court."

It is submitted that counsel for the petitioner has on 01.08.2016 filed spare copy of SLP and accordingly fresh show cause notice to Respondent No. 5 was issued on 16.08.2016.

It is also submitted that as per tracking report item has been delivered but neither AD Cards nor unserved covers containing notice has been received back from Respondent No. 5

The matter is listed before the Ld. Registrar's Court with this office report.
