S. CHANDRAN & ORS. APPELLANT(S)
VERSUS
HENRI TIPHAGNE & ORS. RESPONDENT(S)
CIVIL APPEAL NOS. /2025 [@ SLP(C)No.16666/2024]
O R D E R
1. Leave Granted.
Signature Not Verified
2. These appeals by way of special leave are against the interim order dated 15.07.2024 passed by the High Court of Judicature at Madras in Writ Petition (MD) No. 10526/2021. By the said order, the High Court directed an inquiry by Vigilance and Anti-Corruption Department of the State. Questioning the legality and validity of the interim directions in the peculiar facts and circumstances of the case involving multiple inquiries and reports, the appellants invoked jurisdiction of this Court under Article 136 of the Constitution. While issuing notice, this Court stayed the operation of the judgment till further orders.
3. Ms. Nitya Ramakrishnan, learned senior counsel appearing on behalf of the respondents submits that the interim order of the High Court, impugned before us can be set aside and the High Court Digitally signed by INDU MARWAH Date: 2025.05.09 18:47:03 IST Reason:
may be requested to dispose of the writ petition. The appellants have no objection to the disposal of these appeals, if the interim directions are set aside and the High Court allowed to proceed with the hearing of the writ petition.
4. In view of the above, we allow the appeals in part, set aside the interim order dated 15.07.2024. A request is made for a direction to dispose of the writ petition expeditiously. While we do not consider it appropriate to pass such directions, we leave it to the parties to make such a representation before the High Court and it is for the High Court to take a decision on such request and pass appropriate orders.
5. Pending application(s), if any, shall stand disposed of.
