PETITION FOR SPECIAL LEAVE TO APPEAL (CRL.) NO. 9057 OF 2012

STATE OF H.P. ...PETITIONER

The matter above mentioned was listed before the Hon'ble Court on 19.11.2012 when the Court was pleased to pass the following order:

"Delay condoned. Issue notice."

Accordingly Show Cause Notice was issued to the sole Respondent through Regd. A.D. Post on 01.12.2012.

It is submitted that neither AD card nor unserved cover containing notice has been received back from the sole respondent, so far.

It is further submitted that since the service of the show cause notice could not be effected on the Sole Respondent on usual mode, the matter above mentioned was listed before the Court of Registrar from time to time and listed again on 14.08.2013, when the following order was passed:

"Notice be re issued to the sole respondent through the concerned District court in addition to postal service. List again on 17.9.2013."

Accordingly fresh Show Cause Notice was issued to the sole Respondent through the Chief Judicial Magistrate, Chamba, H.P. as well as through registered AD post on 01.05.2014.

It is submitted that the Chief Judicial Magistrate, Chamba, H.P. vide letter dated 27.05.2014 has submitted the service report stating therein that notice has been served on the sole respondent (copy enclosed).

It is further submitted that A.D. Card duly signed has been received from the sole Respondent but no one has filed Vakalatnama/Appearance on behalf of the sole Respondent.

Service of Show Cause Notice is complete.

The matter is listed before the Hon'ble Court with this office report.
