UPON hearing the counsel the Court made the following O R D E R
It is submitted by Mr. K.V. Vishwanathan, learned Senior counsel and Mr. Rahul Kaushik, learned counsel, appearing for the petitioners that pursuant to the directions issued by the High Court of Madhya Pradesh Bench at Gwalior in WP No.9872 of 2021 vide order dated 24.01.2022, a Committee consisting of ten members was appointed by the M.P. Nursing Council for carrying out inspection of about 271 Nursing Colleges strictly in conformity with Clause 8 of Madhya Pradesh Nursing Shikshan Sanstha Manyatha Niyam, 2018.
According to the report submitted by the Committee, 201 colleges including colleges run by the present petitioners before this Court were cleared by the Committee while 70 colleges were not cleared by the Committee.
Learned counsel further submits that in view of these facts and circumstances of the case, the High Court was not justified in ordering investigation by Central Bureau of Investigation (CBI) into the affairs of every single nursing college in the State from the year 2017 onwards.
Issue notice returnable on 29.11.2022.
Pending further consideration the effect and operation of the judgments and orders dated 27.09.2022 and 28.09.2022 in Writ Petition No.25986/2021 and dated 27.09.2022 and 28.09.2022 in Writ Petition No.26949/2021 which are presently under challenge and other connected matters in so far as the colleges cleared by the Committee, shall remain stayed.
