UPON hearing the counsel the Court made the following O R D E R

Since the impugned order arises out of a direction for a fresh commission, we are not inclined to entertain the present petition.

However, the learned counsel for the petitioner submits that the observation made in paragraph 15 would deprive the petitioner of the benefit of the final decree passed 17.01.2004.

We clarify that, since the final decree dated 17.01.2004 has attained finality, the Commissioner, while conducting the local inspection, would give due weight to the final decree. Signature Not Verified
