Shri Balbir Singh, leaned ASG has pointed out that before filing the present bail application, the applicant has already moved an application for bail before the Bombay High Court, which is not disclosed.

Shri Siddhartha Dave, learned Senior Advocate appearing on behalf of the applicant seeks permission to withdraw the present application with a view to pursue the bail application before the Bombay High Court.

In that view of the matter, the present application stands dismissed as withdrawn in view of the filing of the substantive bail application before the High Court. The bail application before the High Court be considered in accordance with law and on its own merits.
