The writ petitions above-mentioned was listed before the Hon'ble Court on 17.10.2014, when the Court was pleased to pass the following Order:
"Heard.
Issue rule.
Mr. Rakesh Dwivedi, learned senior counsel, today appears for Respondent no.1-High Court. Ms. Preetika Dwivedi, Advocate to file vakalatnama on behalf of Respondent no.1-High Court. Notice shall issue to respondent no.2-State Counter affidavit be filed within eight weeks. Rejoinder affidavit, if any, be filed by the petitioners within two weeks thereafter. No interim order for the present."
It is submitted that pursuant to aforesaid order, a common, returnable rule nisi was issued to respondent no. 1 through Ms. Preetika Dwivedi, Advocate and respondent No. 2 by registered A.D. Ms. Preetika Dwivedi, Advocate has on 21.01.2015 filed counter affidavit on behalf of respondent no. 1 in W.P.(C) no. 851/2014. No counter affidavit has been filed on behalf of respondent no. 1 in W.P. (c)Nos. 852 of 2014 and 860 of 2014 so far. Mr. Abhisth Kumar, Advocate has on 05.05.2016 filed vakalatnama on behalf of respondent no. 2 in all the matters but he has not filed counter affidavit so far.
It is further submitted that counsel for the petitioners has on 25.03.2015 filed rejoinder affidavit to the counter affidavit on behalf of respondent No. 1 in W.P.(C) no. 851/2014.
Service of rule nisi is complete in all the matters.
W.P.(C) No. 721 OF 2016
The writ petition above-mentioned was listed before the Hon'le Court on 16.09.2016, when the Court was pleased to pass the following order:
"Heard. Issue notice in the writ petition and also on the interim prayer, returnable on Monday, the 17th October, 2016. Dasti, in addition, is also permitted. Post along with W.P. (C)No.851 of 2014."
It is submitted that pursuant to the aforesaid order, show cause notice, returnable for 17.10.2016, was issued to both the respondents by speed post on 26.09.2016 and the same has been delivered to both the respondents as per the tracking information of the postal authorities.
It is further submitted that dasti notice was handed over to the counsel for the petitioners on 21.09.2016 and the counsel has on 06.10.2016 filed affidavit of service along with proof of service after serving notice on respondent no. 1 by speed post and respondent no. 2 by dasti. No one has entered appearance on behalf of both the respondents though served with notice.
Service of notice is complete.
It is lastly submitted that all the matters above-mentioned were listed before the Hon'le Court on 17.10.2016, when the Court was pleased to pass the following order:
"Heard. We see no reason to interfere in I.A. No. 2 of 2016 (Application for directions) in W.P.(C) No. 851 of 2014 and I.A. No. 1 of 2016 (Application for directions) in W.P.(C) No. 721 of 2016. The main petitions shall be listed for hearing at an early date after the pleadings are complete."
The writ petitions above-mentioned are listed before the Ld. Registrar Court with this Office Report.
