ITEM NO.3

  • (IA No. 166904/2021 APPLICATION FOR PERMISSION) (IA No. 166905/2021 - CONDONATION OF DELAY IN FILING)
  • Date: 16-02-2022 This matter was called on for hearing today.
  • HON'BLE MR. JUSTICE HEMANT GUPTA CORAM : HON'BLE MR. JUSTICE V. RAMASUBRAMANIAN
  • For Petitioner(s) Mr. Durga Dutt, AOR Mr. Santosh Kumar Yadav, Adv. Mr. Upendra Narayan Mishra, Adv. Mr. Rohit Privadarshi, Adv.

For Respondent(s)

UPON hearing the counsel the Court made the following $0 R D E R$

In spite of order passed by this Court on 14.02.2022, the petitioner is not present today. Mr. Durga Dutt, learned counsel appearing for the petitioner, still states that the Executing Court has given time to the petitioner to vacate the premises on or before 23.02.2022. Such submission is untenable for the reason that the petitioner, Sarvdeep Singh, has filed an undertaking before this Court to vacate the premises within three months of the Order dated 21.10.2021.

Since the petitioner is not present, the presence of Sarvdeep Singh, who has filed the undertaking before this Court, be secured through bailable warrants through jurisdictional police station. Let bailable warrants be issued today itself, returnable on 21.02.2022.

List the matter on 21.02.2022.

The Registry shall allow the petitioner to appear before the Court physically.
